These Terms of Service (“Terms”) govern your use of The Goodie Stash website (the “Site”) and any purchase you make from us. The Site is operated by The Goodies Stach (“we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order. We sell and ship only to addresses within the United States.
2. Products and Information
We try to describe and display our products as accurately as possible, including ingredients, sizes, and colors. However, we do not guarantee that descriptions, images, or other content are complete, current, or error-free, and actual colors may vary depending on your screen. Product packaging and formulas may be changed by the manufacturer.
Pet health notice: Information on the Site is for general informational purposes only and is not veterinary advice. Always follow the manufacturer’s feeding and usage instructions, supervise your pet with toys and chews, and consult your veterinarian about your pet’s diet, health, allergies, or special needs.
3. Prices and Payment
All prices are in U.S. dollars (USD). Applicable sales tax and shipping charges are calculated and shown at checkout. We may change prices at any time, but changes will not affect orders already confirmed. You agree to provide current, complete, and accurate payment and billing information and authorize us and our payment processors to charge your selected payment method for the total amount of your order.
4. Orders
Your order is an offer to buy. We may accept or decline it, and we may limit quantities per customer. An order confirmation email does not mean your order has been accepted; acceptance occurs when we ship the product. If a product is out of stock or was listed at an incorrect price due to an error, we may cancel the order and refund any amount charged.
5. Shipping, Returns, and Refunds
Shipping is governed by our Shipping Policy, and returns and refunds are governed by our Refund & Returns Policy, both of which are part of these Terms. Title and risk of loss pass to you when the product is delivered to the carrier.
6. Accounts
If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Please notify us immediately of any unauthorized use.
7. Acceptable Use
You agree not to use the Site for any unlawful purpose; to interfere with the Site’s security or operation; to use bots, scrapers, or other automated means to access the Site without our permission; or to purchase products for unauthorized resale.
8. Intellectual Property
The Site and its content, including text, graphics, logos, and images, are owned by us or our licensors and are protected by intellectual property laws. Product names and brands belong to their respective owners. You may not copy, reproduce, or distribute Site content without our written permission.
9. Disclaimer of Warranties
Except as expressly stated in these Terms and to the fullest extent permitted by law, the Site and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Any manufacturer’s warranty that comes with a product is provided by the manufacturer, not by us. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
10. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any product. Our total liability for any claim related to a product will not exceed the amount you paid for that product. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at ticianamarket@gmail.com and try in good faith to resolve the dispute informally for at least 30 days. Any claim that is not resolved informally may be brought in the state or federal courts located in Wyoming, or in small claims court if it qualifies.
13. Changes to These Terms
We may update these Terms from time to time by posting a new version on this page and changing the effective date. The Terms in effect when you place an order apply to that order.
